Dear Majority Leader Stewart-Cousins and Speaker Heastie,
New York’s workers have rightly been called heroes throughout the pandemic, for caring for our sick, delivering critical supplies, and keeping our state moving through the emergency. It is a tragedy that so many have died in this service and that so many continue to work without protections from COVID-19. While the state moves to vaccinate workers we know it may be months before many of our members have the opportunity to be vaccinated. Workers simply cannot wait for vaccines to be administered while continuing to work without adequate protections. As the second COVID wave continues to grow in our state, New York’s unions urge you to move quickly to pass the NY HERO Act (S1034/A2681), sponsored by Senator Gianaris and Assembly Member Reyes, to set enforceable health and safety standards to prevent the spread of COVID-19 and future infectious diseases in the workplace.
To stop the second wave, we need to stop workplace spread of the virus. Nearly 40,000 New Yorkers have died from COVID-19, and over one million have tested positive for the virus. Many of the dead are our members who were infected in the course of their jobs. Workers in New York have worked without masks, gloves, or access to sanitary facilities, without being informed of positive tests in their workplace, crowded into spaces where they could not socially distance from coworkers, and without protections from retaliation if they demanded safe working conditions.
The NY HERO Act would direct the Department of Labor to set an airborne infectious disease standard covering all workers and all workplaces in the state. An accompanying prevention plan would include provisions for testing, face masks, PPE, social distancing, hand hygiene, disinfection, and engineering controls. This infectious disease standard will not only protect workers during the COVID-19 pandemic, but also will be critical in ensuring that New York is prepared for future infectious disease outbreaks.
Additionally the act also promotes cooperation between workers and employers. Workplaces with 10 or more workers would be empowered to establish joint employer-worker health and safety committees to review workplace safety plans and operations and make recommendations. As union leaders we know that workers having a voice on the job and working with employers is critical to maintaining safe workplaces.
The pandemic has laid bare the racial injustice that workers face in our state. Black and Latinx workers are more likely to work essential jobs and their communities died from COVID-19 at higher rates than whites. New York’s immigrant communities became the hottest of hot spots at the height of the pandemic, as immigrants working in exploitative conditions in food delivery, agriculture, laundromats, and other industries brought the virus home. Our progressive state cannot stand by while communities of color face a second wave without the workplace protections they were denied in the first wave.
New York’s workers need the NY HERO Act to protect themselves, their families, and their communities from COVID-19, and the next pandemic. We urge you to quickly pass this legislation so no more workers die preventable deaths. The best way to celebrate our heroes is to keep them safe on the job.
